 The State of Texas, County of Fannin

I, Milton Wilks, of the County of Fannin, State of Texas, being of sound and disposing mind and memory and fully realizing the uncertainty of life and the certainty of death; and being desirous of settling my worldly affairs while I possess the capacity and strength so to do hereby make and publish this my last will and testament, hereby revoking all other wills or conditional gifts or gifts heretofore made by me, that is to say:

It is my earnest wish, my whole-hearted desire and sincere prayer that my wife, Mattie C. Wilks, and my daughter, Winnie D. Dizmond with her immediate family, shall jointly possess and occupy and jointly use as one family my present homestead, defraying the expenses for groceries out of the proceeds of the farm, during my wife Mattie’s natural life or until her remarriage, except the forty acres hereinafter set aside for my son, Frank M Wilks. In order to better provide for the maintenance of my wife, Mattie, I now direct and specify that she shall reserve from all the crop or corps on that part of (sixty-two and eight tenths acres) of my homestead set apart hereinafter for my daughter, Winnie, one fourth of all rents less the taxes on the land set apart herein for my daughter Winnie, regardless of who may till the land, the amount of the rents is to be ascertained by the customary methods of paying rents in my community.

I wish and direct that all farm tools, including turning plows, cultivators etc, also the haying outfit, viz. the mower, the hay rack, the buck rake and the hay press, shall remain as permanent equipment for the farm; and I further direct that all my household and kitchen furniture remain as permanent fixtures for the use and conveniences of my wife, Mattie, during her lifetime or until remarriage, and my daughter, Winnie, after which time all my household and kitchen furniture, if there be any, shall become the property of my daughter Winnie except such items and fixtures that may belong individually to my wife, Mattie, who may dispose of her individual belongings as she fit after my death.

I direct that the expenses of my last sickness, including the expenses of my funeral, be first paid, and all of my just debts be next paid in full.

To my son, Frank M Wilks and his heirs, I give and bequeath forty acres of land off the east end of a fifty acre tract of land in the southwest corner of the J H Knap Survey, 14 miles north east of Bonham, Texas; and I further say and direct that my son, Frank, shall assume full charge and control

of said forty acres immediately after my death, except that I reserve the growing or grown crops, if there be any on the said forty acres at the time of my death to the use of my wife, Mattie C Wilks.

To my daughter, Winnie, and her bodily heirs I give and bequeath ten acres of land off the west end of fifty acres described above, also fifty two and eight-tenths acres adjoining the fifty acres named above on the west out of the southeast corner of the J. A Windle Survey 14 miles northeast of Bonham, Texas. The said daughter, Winnie, with her husband shall have joint possession with my wife to my present home and the land herein set aside for my daughter, Winnie, after my death.

To my son-in-law Winnie’s husband, I give and bequeath one mule and wagon.

To my wife, Mattie C. Wilks, I give and bequeath her choice of one cow and its calf.

I hereby nominate and appoint my daughter, Winnie D Dizmond, the sole executrix of this my last will and testament, and direct that no bond be required of her, and that no action be had in the probate court under this will other than the filing of an inventory and appraisement and list of claims as required by law.

In testimony of all which, I hereunto set my hand at Lamasco, Texas, in the presence of T. H. Eller and J. T. Hayes witnesses 11 day of July AD 1927.
